Article 1 – Scope and Definitions
1.1. These Terms and Conditions (“Terms”) govern the legal relationship between Recode Records (“RECODE”, “we”, “us”) and any individual or entity (“Customer”) who purchases or orders an admission ticket for an event organized by RECODE. This includes tickets bought directly from RECODE or via an authorized ticketing partner. These Terms also apply to anyone attending the event (“Visitor”).
1.2. The term “Event” refers to any musical performance, concert, festival, or similar gathering organized or co-organized by RECODE.
1.3. “Venue” refers to the physical location where the event is held, including any adjacent areas or spaces that form part of the event grounds.
1.4. Any general terms and conditions provided by the Customer or Visitor are explicitly rejected and do not apply.

Personal Information You Provide
2.1. Tickets may be issued in physical or electronic form (such as a barcode or QR code) by RECODE or its authorized ticketing partners.
2.2. Each ticket is valid for a single individual and grants one-time entry to the event.
2.3. Admission tickets remain the property of RECODE. The first person who presents a valid ticket at the entrance will be granted access, and RECODE assumes that this individual is the rightful ticket holder. Further verification of ownership is not required.
2.4. Once a ticket has been issued, the Customer assumes full responsibility for its safekeeping. RECODE is not liable for lost, stolen, damaged, or misused tickets.
2.5. Tickets purchased only through RECODE or its officially designated sales channels are guaranteed to be valid. Customers bear the responsibility of proving their ticket’s authenticity.
2.6. Electronic tickets are delivered via email or other digital means. The Customer must ensure they can receive and securely store the ticket. RECODE does not guarantee the successful receipt or confidentiality of electronic tickets.
2.7. RECODE may impose limits on the number of tickets a single Customer can purchase. Customers must adhere to these restrictions.
2.8. Tickets are non-refundable unless otherwise stated by law. Dutch Civil Code Article 6:230p sub e applies to ticket sales.

Article 3 – Ticket Resale & Unauthorized Use
.1. Customers are prohibited from reselling, transferring, or using tickets for commercial purposes without RECODE’s prior approval. RECODE may allow ticket resale through designated platforms under specific conditions.
3.2. Customers may not use tickets to promote or advertise any products, services, or commercial activities without RECODE’s written consent.
3.3. If a Customer transfers a ticket to another person for non-commercial purposes, they must ensure that the new holder abides by these Terms. If RECODE implements personalized (non-transferable) tickets, only the named individual on the ticket may attend. RECODE reserves the right to check the ticket holder’s identification and deny entry if the names do not match.
3.4. Violation of these terms results in a penalty of €10,000 per breach, plus €5,000 per day for continued violations. This does not limit RECODE’s right to seek further damages.
3.2. Customers may not use tickets to promote or advertise any products, services, or commercial activities without RECODE’s written consent.
3.3. If a Customer transfers a ticket to another person for non-commercial purposes, they must ensure that the new holder abides by these Terms. Article 4 – Visitor Obligations & Event Conduct
4.1. Security personnel may conduct searches upon entry. Refusal to comply may result in denial of entry.
4.2. Visitors must carry their valid ticket at all times during the event and present it upon request by RECODE staff or security.
4.3. Visitors may be required to show a valid ID to confirm their age and comply with local laws, such as alcohol regulations.
4.4. Large bags, backpacks, and items exceeding A4 size are prohibited. RECODE may impose additional restrictions per event. Non-compliant items will not be stored.
4.5. The use of professional recording equipment (photo, video, or audio) is not allowed. Confiscated items will not be returned.
4.6. Visitors are not allowed to bring glass containers, cans, fireworks, weapons, hazardous objects, or alcohol onto the event premises. Confiscated items will not be returned, and illegal objects will be reported to authorities.
4.7. Unauthorized recording of the event, including photography, filming, and audio recording, is strictly forbidden. Any unauthorized materials may be confiscated and deleted.
4.8. Once a Visitor exits the venue, their ticket becomes invalid for re-entry.
4.9. Visitors must follow all rules, regulations, and instructions given by RECODE staff, security personnel, and venue operators. If a smoking ban is in effect, it applies to all types of smoking, including e-cigarettes.
4.10. Certain events may have a minimum age requirement, which will be communicated in advance.
4.2. Visitors must carry their valid ticket at all times during the event and present it upon request by RECODE staff or security.
4.3. Visitors may be required to show a valid ID to confirm their age and comply with local laws, such as alcohol regulations.

5.1. If a Visitor violates these Terms, RECODE reserves the right to cancel their ticket or deny entry without refund.
5.2. Visitors may be removed from the event for disorderly behavior or any action that disrupts the event.
5.3. Tickets suspected of being counterfeit or illegally resold may be voided, and entry will be denied without compensation.
5.4. RECODE and associated artists may record and use event footage for promotional purposes. Attendees acknowledge that they may appear in such materials and waive any rights to compensation.
5.5. RECODE reserves the right to implement additional security and operational measures as necessary. Visitors are responsible for staying informed about any updates.
5.2. Visitors may be removed from the event for disorderly behavior or any action that disrupts the event.
5.3. Tickets suspected of being counterfeit or illegally resold may be voided, and entry will be denied without compensation.
5.4. RECODE and associated artists may record and use event footage for promotional purposes. Attendees acknowledge that they may appear in such materials and waive any rights to compensation.
5.5. RECODE reserves the right to implement additional security and operational measures as necessary. Visitors are responsible for staying informed about any updates.
Article 6 – Event Cancellations & Rescheduling
6.1. RECODE reserves the right to cancel or reschedule an event due to unforeseen circumstances, including but not limited to extreme weather, artist cancellations, health crises, or technical failures.
6.2. If an event is canceled before it begins, ticket holders are entitled to a refund of the ticket’s base price (excluding service fees). Refunds will be processed according to RECODE’s official procedure. Travel and accommodation costs are not reimbursed.
6.3. If an event is rescheduled, tickets remain valid for the new date. Customers who cannot attend on the new date may request a refund within the specified time frame. Refund rights expire on the date of the rescheduled event.
6.2. If an event is canceled before it begins, ticket holders are entitled to a refund of the ticket’s base price (excluding service fees). Refunds will be processed according to RECODE’s official procedure. Travel and accommodation costs are not reimbursed.
6.3. If an event is rescheduled, tickets remain valid for the new date. Customers who cannot attend on the new date may request a refund within the specified time frame. Refund rights expire on the date of the rescheduled event.
Article 7 – Liability
7.1. RECODE is only liable for direct damages resulting from proven negligence, and compensation is limited to the amount covered by insurance.
7.2. Attending an event is at the Visitor’s own risk. RECODE is not responsible for injuries, hearing damage, or other health-related issues.
7.3. RECODE strives to follow the announced schedule but is not responsible for changes to event timing or artist lineups.
7.4. Lost or stolen tickets are the responsibility of the Customer. RECODE is not liable for any losses incurred.
7.5. Visitors acknowledge that attending large gatherings involves potential health risks, including exposure to infectious diseases. RECODE follows necessary precautions but is not liable for any health-related consequences.

Article 8 – Data Protection
8.1. RECODE processes personal data in compliance with its Privacy Policy, available on our website. By purchasing a ticket, Customers consent to the processing of their personal data as outlined in the Privacy Policy.
Article 9 – General Provisions
9.1. RECODE reserves the right to update these Terms at any time. Significant changes will be communicated through official channels.
9.2. These Terms are governed by Dutch law.
9.3. Any disputes arising from these Terms will be exclusively handled by the courts in Rotterdam.
